Terms of Use

Last updated: September 2026

These Terms of Use apply to your use of the website.

This website is used by two separate professional services businesses:

  • Phan Campbell & Associates Pty Ltd (ABN 57 064 627 998) provides accounting, taxation and business advisory services.
  • Phan Campbell & Associates Lawyers Pty Ltd (ABN 34 667 793 197) provides legal services.

We refer to them together on this website as PCA, we, us or our where the context permits. Where a provision relates to a particular service, it applies to the entity providing that service.

Although both businesses operate under the PCA name and use this website, they are separate legal entities. An engagement with one does not, by itself, constitute an engagement with the other.

1. Using this website

This website provides general information about PCA, the services we provide and matters which may be relevant to our clients and prospective clients.

By accessing or using this website, you agree to these Terms of Use.

We may update these terms from time to time. Any updated terms will apply from the date they are published on this website.

2. Information on this website is general only

Information published on this website is general in nature.

It is not legal, taxation, accounting, financial or other professional advice and should not be relied upon as a substitute for advice that takes account of your particular circumstances.

Laws, regulatory requirements and professional practices change over time. Although we take reasonable care in preparing our website content, information may not remain current after its publication date and may not apply to your circumstances or jurisdiction.

You should obtain appropriate professional advice before acting, or deciding not to act, on information contained on this website.

3. Contacting us does not create a professional relationship

Visiting this website, submitting an enquiry, sending us information, telephoning our office or booking an appointment does not, by itself, create a lawyer-client, accountant-client or other professional relationship with either PCA entity.

Before accepting an engagement, we may need to consider matters including the nature and scope of the proposed work, conflicts of interest, our professional obligations, our capacity to act and applicable client identification and due diligence requirements.

An engagement only commences when the relevant PCA entity has agreed to act for you and the applicable engagement arrangements have been confirmed.

Until then, you should not assume that we act for you or that we have accepted responsibility for any deadline, transaction, proceeding or other matter.

Please do not send original documents or highly sensitive information unless we have asked you to do so through an appropriate communication channel.

4. Our engagement documents

The professional services provided by each PCA entity are governed by separate engagement arrangements.

If you engage Phan Campbell & Associates Pty Ltd for accounting, taxation or business advisory services, the scope and terms of that engagement will be set out in the applicable engagement letter and any documents referred to in it.

If you engage Phan Campbell & Associates Lawyers Pty Ltd for legal services, the scope and terms of the engagement will be set out in the applicable engagement letter, engagement terms, costs disclosure or costs agreement and any other documents relevant to the particular matter.

Those engagement documents govern the professional relationship between you and the relevant PCA entity.

If there is any inconsistency between these website Terms of Use and the terms of a professional engagement, the applicable engagement documents prevail in relation to that engagement.

5. Working with both PCA businesses

Some clients may require both legal and accounting services.

Where this occurs, you may engage each PCA entity separately. Each entity remains responsible for the professional services it provides under its own engagement with you.

Information will only be shared between the legal and accounting businesses where you have authorised that sharing or where disclosure is otherwise permitted or required by law.

Our handling of personal information is explained further in our Privacy Policy.

6. Identity verification and regulatory requirements

Depending on the services you ask us to provide, we may be required to undertake identity verification, customer due diligence or other regulatory checks before commencing or continuing work.

This may include requirements arising under the Anti-Money Laundering and Counter-Terrorism Financing Act 2006 (Cth) and associated legislation and rules.

Where those requirements apply, we may need to obtain and verify information about you and, where relevant, other persons or entities connected with a matter. This may include information concerning ownership or control, the purpose and nature of a transaction or engagement, and the source of funds or wealth.

We may also be subject to ongoing monitoring, record keeping and reporting obligations.

There may be circumstances in which we cannot commence or continue providing particular services until our regulatory obligations have been satisfied.

Further information may be provided in the relevant engagement documents or when we request information from you.

7. Accuracy and availability

We take reasonable care in maintaining this website. However, to the extent permitted by law, we do not warrant that:

  • all information on the website is complete, current or suitable for your particular circumstances;
  • access to the website will always be uninterrupted or error free; or
  • the website or material made available through it will always be free from viruses or other harmful components.

We may change, suspend or withdraw any part of the website without notice.

8. Electronic communications and security

Communications over the internet are not always secure.

Emails, online forms and other electronic communications may be intercepted, delayed, corrupted or misdirected. You should exercise appropriate care when sending confidential or sensitive information electronically.

If you receive an email or other communication purporting to be from PCA which contains unexpected payment instructions or changes to bank account details, you should verify those instructions directly with us using independently verified contact details before making payment.

9. External websites

This website may contain links to websites or services operated by third parties.

Those links are provided for convenience and information only. Unless expressly stated otherwise, a link does not indicate that PCA endorses, controls or accepts responsibility for the third-party website, its operator, its content or its services.

Your use of an external website is subject to the terms and privacy practices of that website.

10. Intellectual property

Unless otherwise indicated, the content of this website, including written material, graphics, branding and other material, is owned by or licensed to PCA and is protected by applicable intellectual property laws.

You may view, download or print website material for your personal use or internal business purposes.

You must not reproduce, republish, adapt, distribute or commercially exploit substantial parts of our website content without our prior written consent, except where permitted by law.

You may link to publicly available pages on our website provided the link is not misleading and does not suggest an association, endorsement or relationship that does not exist.

Our names, logos and branding must not be used without our prior written consent.

11. Acceptable use

You must not use this website:

  • for an unlawful purpose;
  • in a way that infringes another person's rights;
  • to introduce malicious software or other harmful material;
  • to interfere with the operation or security of the website;
  • to obtain unauthorised access to any system, information or account; or
  • in any other manner that may damage the website or materially interfere with another person's use of it.

12. Liability

Nothing in these Terms of Use excludes, restricts or modifies any right, guarantee, condition, warranty or liability which cannot lawfully be excluded, restricted or modified.

Subject to those rights and to the maximum extent permitted by law, PCA is not responsible for loss arising from reliance on general information published on this website in circumstances where professional advice appropriate to the user's particular circumstances has not been obtained.

We are not responsible for the content, availability or operation of third-party websites or services linked from this website.

13. Electronic addresses

Email addresses and other electronic contact details published on this website are provided for legitimate business communications.

Their publication should not be taken as consent to receive unsolicited commercial electronic messages.

14. Privacy

We handle personal information in accordance with our Privacy Policy.

Our Privacy Policy explains how the two PCA entities collect, hold, use and disclose personal information and how you may contact us about privacy matters.

15. Governing law

These Terms of Use are governed by the laws of Victoria, Australia.

The courts of Victoria and courts entitled to hear appeals from them have non-exclusive jurisdiction in relation to matters arising from these Terms of Use or use of this website.
